Sochi 2014 is deemed to have "marketing control" over an event or program if:
• Sochi 2014 (or a third party appointed by Sochi 2014) offers any marketing rights in connection with the event or program;
• the event or program is promoted (whether by Sochi 2014 or by a third party appointed by Sochi 2014) in connection with the Games or a Sochi 2014 mark or is using a Sochi 2014 mark or a ROC mark; or
• the event is otherwise promoted (whether by Sochi 2014 or by a third party appointed by Sochi 2014) as “Olympic”.
